France may soon enact the worst copyright law in Europe, sneaking it through in a legislative session scheduled for December 22 and 23.

Europe's equivalent to the US Digital Millennium Copyright Act (DMCA) is a controversial directive called the EUCD. Each EU state is responsible for implementing the minimum set of EUCD restrictions (which are far from minimal!) but each state can exceed the minimum, and the entertainment lobby pushes hard to see to it that they do. They've run amok in France, subverting the lawmaking process with a farcical wish-list of penalties, mandates and software bans.

Copyfighters in France have published a detailed alert in French; what follows is a loose, machine-assisted translation (substantive corrections gladly sought):

* A prohibition on all software that permits transmission [disposition is unclear without greater context] of copyrighted material that does not integrate both a watermark and DRM
* A prohibition on marketing or advertising such software
* These prohibitions include legal sanctions<
* DRM mandates for digital radio transmission
* A universal wiretapping system for private communication [This is defined elsewhere as a system to check for, say, music files attached to email messages, and not one that would violate the "secret of private correspondence".]
* Creation of a universal filering system for all ISPs


The French Department of Culture has also threatened to ban Free/Open Source Software:

Friday November 18th, 2005, French Department of Culture. SNEP and SCPP have told Free Software authors: "You will be required to change your licenses." SACEM add: "You shall stop publishing free software," and warn they are ready "to sue free software authors who will keep on publishing source code" should the "VU/SACEM/BSA/FA Contents Department"[1] bill proposal pass in the Parliament.

I dont wanna burn any cars or any building government and i'm not terrorist poster...

The French Department of Culture is a crap department, this thread is only to say no, help us before its happening... Artist will not be protected by this law, only big company will receive the real benefits...

Free scene will die for sure !!!

And keep this in mind :: Eventually all countries will get laws like this.

To all members :: you could help us by your vote, and by the way, oblige the french parliament to choose "NO"...

If french parliament choose "YES" !!!
* Lot's of European's governments (and may be all...) will have to vote for this law, and if this law is voted "YES", the european's freedom will be a piece of crap for a free world !!!

December 23, will be too late for voting !!!

Wow, scary stuff!

Here I was getting fed up with the American gov't cause they're more concerned with raising money for thier next election than doing their job. Sounds like France is in the same boat.

If I understand this right they want to force people who would willingly share their music and intellectual prperty for FREE, to stop doing so? What kind of freedom do they claim to have in France anyway. Oh yea, freedom to burn stuff cause France didn't turn out to be the land of opportunity you thought it was when you moved there.

I hope you guys can make a difference, being from the states I'm not sure what I can do, but good luck and let me know if I can do something to help.

Oh well good luck to the french in trying to implement &
unhold those kind of laws.
Cos theres so many bad-boy (& bad-girl) hackers out there
that a crack or work-around will surface within a week.

wtf!! so hold on......as ndanger said..this ruling means artists...the actual artists will not be able to share theri own music and intellectual property rights......or does it mean people will not be able to download music for free.

once again just goes to show that governments do not represent the wishes of the people but rather the growtrh of their equity funds and paying for that 3 million quid mortgage they got.
